1. About this policy

This Privacy Policy explains how Luminous Skin Cancer and Scar Centre (Luminous, we, us or our) handles personal information in connection with Modiari: Mole Diary (Modiari), the Modiari website and related Modiari services.

Modiari is designed as a local-first mole and skin spot diary. Most diary information, including photographs and lesion records, is stored on the user's device. Information leaves the device only for particular features described in this policy, such as user-invoked image processing, referral or premium entitlement checks, user-directed backup/export/share actions, or an Ask Luminous request.

Privacy summary: Modiari does not contain third-party advertising. We do not sell your personal information or skin photographs, and we do not use skin photographs for advertising. We do not use your photographs to train or improve an AI model unless a separate optional program is introduced and you give separate, explicit consent.

2. Health information and scope

Modiari is a personal tracking and comparison tool. It is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. Image alignment and comparison functions help users compare photographs over time and are not a diagnosis of skin cancer or any other condition.

Ask Luminous is a preliminary image review or triage service only. It is not an emergency service and does not replace a complete skin examination, dermoscopy, biopsy or face-to-face medical assessment. Consult an appropriately qualified healthcare professional for medical advice, diagnosis or treatment.

3. Information handled by Modiari

3.1 Information normally stored on your device

Depending on the features you use, Modiari may store locally:

Your complete local diary is not automatically uploaded to Luminous. Luminous may not have a copy of information that exists only on your device.

3.2 Camera, photos, files and notifications

Modiari may use your device time zone locally so reminders occur at the expected local time. Modiari does not require precise GPS location for its core mole diary functions.

3.3 Referral, premium and entitlement information

Referral and premium features may use an online entitlement service. This service may receive an anonymous installation identifier, device-binding identifier, entitlement or referral tokens, app version, referral state, purchase status and related technical metadata. These services are designed not to receive your complete local diary or lesion photographs.

3.4 Automated image alignment and comparison

When you choose to run an automated image alignment/comparison feature, Modiari may transmit the image views you selected, together with image data needed to perform the alignment, to an image-processing service configured for Modiari. The service processes those images to calculate alignment and returns comparison or warped-image results to the app.

This processing is for image alignment and comparison. The images are not sold, used for advertising, or used to train or improve an AI model without separate explicit consent. Limited technical information may be retained where reasonably necessary for security, reliability, troubleshooting or legal obligations.

3.5 Ask Luminous

Ask Luminous is optional. If you submit an Ask Luminous request, the app asks you to confirm consent to sending selected images and information to Luminous. Depending on what you provide, the submission may include:

Information submitted for a clinical review may form part of Luminous's health service or clinical records and may be retained where required by applicable health-record, professional or other legal obligations.

3.6 Payments and purchases

Clinical-service payments may be processed by Stripe. Premium app purchases on Android may be processed through Google Play. Those providers process payment, account, device or transaction information under their own privacy terms. Luminous may receive transaction identifiers, purchase tokens, payment status, amount and entitlement information.

3.7 Technical information

When Modiari communicates with online services, our systems or hosting providers may process ordinary technical information such as IP address, request time, app version, server response, error information and security logs. We use this to operate, secure and troubleshoot the service and to prevent misuse or fraud.

We do not sell personal information. We do not disclose skin photographs to advertisers and do not create advertising profiles from health or skin-image information.

6. Backups, exports and user-directed sharing

Where available, Modiari can create an encrypted backup of app data. You control where that backup is saved or transferred. If you save a backup to a cloud drive, email it, share it through another app or export information to another service, the chosen recipient or provider may process that information under its own privacy terms.

A Modiari app pattern is an access-control convenience and is not a substitute for device-level encryption. Protect your phone or tablet with its operating-system security features and keep any recovery code secure.

7. Data retention and deletion

7.1 Local diary information

Local diary information generally remains on your device until you delete it, clear the app's data or uninstall the app, subject to any device or operating-system backup that you have enabled. Where the Modiari Trash feature is available, deleted items may remain locally recoverable for up to 30 days before permanent deletion.

7.2 Online service information

Entitlement, referral, purchase-verification and technical records may be retained for as long as reasonably necessary to provide the relevant feature, maintain security, prevent fraud, resolve disputes and meet legal or accounting requirements.

7.3 Ask Luminous information

Information submitted to Luminous for a clinical or health-related service may need to be kept for periods required by applicable health-record, professional, taxation, insurance or other legal obligations. Some information therefore cannot always be deleted immediately on request.

8. Access, correction and deletion requests

You can manage much of the local Modiari diary directly in the app. If information exists only on your device, Luminous may be unable to access, recover or delete it for you.

You may request access to, correction of, or deletion of personal information that Luminous holds. We may need to verify identity before acting and lawful retention exceptions may apply.

9. Security

We take reasonable technical and organisational steps to protect information we hold from misuse, interference, loss and unauthorised access, modification or disclosure. No electronic system is completely secure, so users should also maintain device security and keep Modiari and the operating system up to date.

10. Overseas processing

Some providers used in connection with Modiari, including Google and Stripe, may process information outside Australia, including in the United States and other countries in which they or their providers operate. Provider infrastructure can change over time.

11. Australian privacy and health-information laws

Luminous is an Australian health service provider. We handle personal information in accordance with applicable privacy and health-information laws, including the Privacy Act 1988 (Cth) and, where applicable, the Health Records and Information Privacy Act 2002 (NSW).

12. Children and use on behalf of another person

Modiari is not specifically designed as a children's app. If you use Modiari to record or submit information about another person, including a child, only do so where you have lawful authority to act for that person and to handle or disclose their information.

13. Privacy complaints

If you have a privacy concern or complaint, contact us using the details below and explain the issue. You may also have rights to complain to the Office of the Australian Information Commissioner or, where applicable, the Information and Privacy Commission NSW.

14. Changes to this policy

We may update this policy when Modiari's features, technology, providers or legal obligations change. The current version will be published on this page with a revised update date.
