1. About Modiari

Modiari is a personal mole and skin spot diary provided by Luminous Skin Cancer and Scar Centre. These Terms apply to your use of the Modiari app, website and related services.

3. Your responsibility for your diary

The core Modiari diary is stored locally on your device. You are responsible for protecting your device, maintaining any backup you choose to create, and keeping recovery information secure. Luminous cannot guarantee recovery of information that exists only on your device.

4. Photographs and user content

You retain responsibility for photographs, notes and other content you add to Modiari. Only upload, photograph or submit information where you have lawful authority to do so. If you record information about another person, you are responsible for obtaining any permission or authority required.

5. Ask Luminous

Ask Luminous is an optional preliminary image review or triage service. It is not an emergency service and does not replace an in-person skin examination, dermoscopy, biopsy or other clinical assessment. Availability, response times, pricing and eligibility may vary.

6. Premium features and purchases

Some Modiari features may require a premium entitlement or in-app purchase. Prices and purchase terms shown by Google Play, Apple or another authorised payment provider apply to transactions made through that provider. Purchase verification, entitlement restoration and anti-fraud checks may require communication with online services.

7. Payments for clinical services

Where Modiari offers payment for a clinical service, payment may be processed by a third-party payment provider such as Stripe. Additional service-specific terms, eligibility rules, fees or consent requirements may be shown before you submit a request.

8. Acceptable use

You must not misuse Modiari or its services, including by:

• attempting to gain unauthorised access to systems or other users' information;
• interfering with security, entitlement, payment or anti-fraud controls;
• uploading unlawful, malicious or infringing material; or
• using the service in a way that could harm users, Luminous or third parties.

9. Availability and changes

We may update Modiari, change features, correct errors or discontinue features where reasonably necessary. Online features depend on network availability and may occasionally be unavailable for maintenance or technical reasons.

10. Consumer rights

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including rights under applicable Australian consumer law.
